ERISA is the acronym for The Employee Retirement Income Security Act and was enacted by the 93rd United States Congress on September 2, 1974. Designed to provide pension reform, the act is a federal law that sets standards and regulations of protection for individuals that are in private sector company retirement plans.
ERISA protects retirement savings from mismanagement and abuse , and clarifies that those in charge of those savings be held to a high standard - that is, they must act in the best interests of plan participants. It also requires transparency and accountability, ensuring that participants have access to information about their plans.
ERISA requires accountability of plan fiduciaries and generally defines a fiduciary as anyone who exercises discretionary authority or control over a plan’s management or assets, including anyone who provides investment advice to the plan.
